One major difference lies in the safeguards, or lack of them, against arbitrary detention on mere suspicion with no, or flimsy, evidence. In continental jurisdictions a person can be imprisoned, pending investigation, on mere suspicion by the investigating-and-prosecuting judge, confirmed by a colleague. There is no right to a public hearing, nor obligation on the prosecution to exhibit any evidence. This is collected later, while the suspect stays in jail. There is a time limit on how long a suspect can be held, and in several jurisdictions this is six months, which can be extended. It is not restricted to terrorism cases. The EU commission already has a blueprint for a single EU-wide criminal code based on continental principles, called "Corpus Juris", and article 20.3.g of this code provides that a prosecutor can have a suspect imprisoned pro-tem for up to six months (extensible).
